A Question about guest parking from the Annual Meeting

 

During our Annual CHOA Meeting a resident voiced a concern that golf shots that result in damage to cars parked in some of our guest parking. The concern was taken seriously and has been investigated.

 

Results of investigation

Trees/plants as a remedy will not work because of the trajectory of the golf ball in the areas where there is guest parking usually would not be a line drive but a high fly ball

High Screen/Fence as a remedy will not work unless we were to build a 30 ft fence

We will continue to look into a solution. If you have any ideas, we would love to hear from you. Please reply below

    Is the question one of liability? Is it the golfer’s responsibility to pay for the damage or Charbonneau’s? You probably couldn’t build anything to prevent any possible trajectory of the golf ball. What about posting each of the parking areas that are susceptible to such an occurrence with a sign, stating that “Parking is at Owner’s Risk. Auto could be subject to damage by errant golf balls”. (Would suggest an attorney review the language to be sure Charbonneau isn’t assuming the liability by such a sign.) Also worth checking with Jay Puppo.

    I have two golf ball pings in my car. In the past, I have considered part of the risk of living here and having to park my car in the dirveway. However, the recent unfriendly, very unneighborly, and sometimes beligerent attitude of the golf course board makes me think that we should should be asking for damages! I encouage our CHOA Board to look into this matter further and let the golf course board know that there are other sides to their “safety” concerns. Eric Hoem

    We will be discussing the issue and your ideas at our next board meeting on November 11th. I wanted you to know that your post had been read and that there would be followup after our meeting. Also, you are welcome to attend the meeting which is held at the Poolhouse on Lafayette St on Wednesday November 11th at 10:00 am

    After discussion with the board and our insurance agent
    In response to the questions/comments about liability for cars parked in guest parking getting hit by golf balls.

    In checking with Insurance companies, and you should check with your own insurance company to confirm, the owner of the car being hit by a golf ball would place a Comprehensive claim with their own insurance company. This would be similar to getting a rock in your windshield while driving on the freeway.
